General

  1. The Promoter is APN Newspapers Pty Ltd (ABN 21 009 657 943) Corner Mayne Road & Campbell Street, Bowen Hills Queensland 4006.  (“the Promoter”). Telephone Number: (07) 3623 1643. Authorised under Permit NSW/LTPS/17/15930.
  2. These terms and conditions relate to the Trades Toolbox 2.0 (Competition).
  3. By purchasing a Subscription (as defined in clause 11), entrants accept these Terms and Conditions and the APNARM Advertising Terms and Conditions available at http://www.apn.com.au/advertising-terms/ and Finda Terms and Conditions available at: https://finda.com.au/lc-ad-terms-conditions/
  4. At all times, any advertiser has the choice of opting out of the Trades Toolbox 2.0 competition. Advertisers can write or email the Promoter at the address shown (Clause 1) to request they take up the opt-out option. 
  5. If there is any inconsistency between these Terms and Conditions and anything else that refers to the Competition, these Terms and Conditions prevail.

Who can enter

  1. Entry is open to all permanent residents of Queensland and New South Wales who live in the distribution areas of the listed daily newspaper publications and their non-daily community newspapers; except employees and immediate families of the Promoter and their associated companies and agencies.
  2. Immediate family includes the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
  3. Entrants must be 18 years of age or older as at the date of entry to be eligible to enter the competition.
  4. The Promoter reserves the right to request any winner to provide proof of identity and proof of residency to claim a prize.
  5. Entry to the Competition is open to, and automatic for all participants who have purchased a Trades Tool Box 2.0 Subscription in the listed publications at the prevailing market rates shown at Clause 11.

Subscriptions

  1. There are four (4) subscriptions a participant can choose to purchase; these are:
  • Starter Subscription, RRP $45.00 per week for 52 weeks (incl. of GST)
    • One 5cm x 2cm Column Classified advertisement per week for a minimum of 52 weeks.
    • Finda Premium Listing
    • Find Your Local Premium Listing
    • Three Page Website
    • Service Central Standard
    • Total cost of the Starter Subscription is $2,340.00 (incl. of GST).
  • Plus Subscription, RRP $65.00 per week for 52 weeks (incl. of GST).
    • Two 6cm x 2cm Column Classified advertisements per week for a minimum of 52 weeks.
    • Finda Premium Listing;
    • Find Your Local Premium Listing;
    • Three Page website;
    • Service Central Standard;
    • Total cost of the Plus Subscription is $3,380.00 (incl. of GST).
  • Premium Subscription, RRP $85.00 per week for 52 weeks (incl. of GST)
    • Two 8cm x 2cm Column Classified advertisements per week for a minimum of 52 weeks;
    • One 3cm x 2cm Column Run of Press advertisement per month;
    • Finda Premium Listing;
    • Find Your Local Premium Listing;
    • Five Page website;
    • Service Central Standard;
    • Total cost of the Premium Subscription is $4,420.00 (incl. of GST).
  • Ultimate Subscription, RRP $140.00 per week for 52 weeks (incl. of GST).
    • Four 8cm x 2cm Column Classified advertisements per week;
    • One 3cm x 2cm Column Run of Press advertisement per month;
    • Finda Premium Listing;
    • Five Page website;
    • Service Central Standard; plus
    • 10,000 impressions on a digital MREC, Leaderboard or Mobile banner for the month;
    • Total cost of the Ultimate Subscription is $7,280.00 (incl. of GST).
  1. If a participant does not wish to be entered in to the competition, they must provide written notice to the Promoter at the address specified in Clause 1 prior to the end of the Promotion Period.
  2. Contestants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.

How to enter

  1. Free entry is automatically available to those participants who have purchased a Trades Toolbox 2.0 subscription package at the prevailing market rate between Wednesday August 2, 2017 and Friday September 15, 2017.
  2. The Trades Toolbox 2.0 competition commences on Wednesday August 2, 2017 and closes at 5:00pm AEST Friday September 15, 2017.   
  3. Bookings for at least one (1) of the advertisements must run prior to Saturday September 29, 2017. A purchase of a Trade Toolbox 2.0 Subscription must take place prior to the closing date of the promotion.
  4. Subject to these Terms and Conditions, the purchase of a Trade Toolbox 2.0 Subscription will entitle the participant to one (1) entry into the competition regardless of how many subscriptions are purchased.  
  5. Newspaper publications included in the advertising subscription promotion and competition are the daily newspaper publications and its non-daily community newspapers; including:
  • Lismore - The Northern Star;
    • Grafton - The Daily Examiner;
    • Warwick - Warwick Daily News;
    • Toowoomba - The Chronicle;
    • Ipswich – QT;
    • Gympie - The Gympie Times;
    • Sunshine Coast - Sunshine Coast Daily;
    • Bundaberg – NewsMail;
    • Gladstone - The Observer;
    • Rockhampton - The Morning Bulletin;
    • Mackay - Daily Mercury;

Charges and Fees

  1. The subscription fees per week for the term of the selected subscription/s is payable: A) for the full 12 months in advance on a 7 day account, or B) Each month at month end on a 30 day account as notified by the Promoter and on the terms of this Schedule and any tax invoice issued by the Promoter.

The first weekly fee will be charged from the commencement of any of the above Subscriptions or paid on advance on a 7 day account.

  1. Fees are non-refundable for the term of the subscription/s.  In the event, there is a default with any payment required by the participant under this Schedule, all Products and Services will be suspended; and all fees not paid for the minimum term are immediately due and payable.

Cancellations

  1.  If the participant cancels the Trade Toolbox 2.0 Subscription prior to the end of the Term of the subscription, all weekly fees not paid are immediately due and payable on a 30 day account. Any fee’s already paid for 7 day account customers are forfeited and will not be refunded . If the participant cancels the Trade Toolbox 2.0 Subscription after the term of the subscription, the cancellation will be verified and processed the week following receipt of the cancellation by the Promoter from the customer and chargers will cease at time of processing. 7 day account customers will be renewed on a 12 month basis and any fees already paid upon cancellation will be forfeited.

Taxes and Delivery Costs

  1. Any taxes and delivery costs which may be payable because of the participant purchasing a subscription should seek advice from a suitably qualified tax professional about the applicable tax implications for them.

Prizes

  1. There will be five (5) winners selected via random draw from all valid entries received from all regions participating in the competition (refer Clause 18) with each winner receiving the following prize:
    • 1 of 5 Weekends for two adults to the Gold Coast to attend the V8s at the Gold Coast Friday to Sunday, October 20 – 23, 2017 (inclusive);
    • Accommodation for 2 adults at Watermark, Surfers Paradise Boulevard, Surfers Paradise Queensland.
    • Winners who reside over 250km from the Gold Coast will receive flights and transfer vouchers to the value of $1,000.00 to travel return to the Gold Coast event.
    • Any costs incurred over the value of the flight voucher and event package will be the responsibility of the winner.
    • Travel and accommodation prize must be used for the V8 Gold Coast event only.
    • Winners who qualify for the travel vouchers are responsible for booking their travel to the event.
  • Dates for the event are non-negotiable.
  • All entrants should be available to travel to the Gold Coast for the V8 event if they are chosen as a winner.
    • Any meals, beverages, gratuities, beverages, outings, hotel costs (other than specified) and any other incidental costs are at the winner’s expense. 
    • Accommodation is for room only and does not include any further inclusions or incidental costs.
    • The winners must collect their prizes from their local newspaper office (refer listing Clause 25) by 4:00pm AEST Wednesday September 27, 2017. 
    • Total Prize value is up to $1,931.15 (incl. of GST).  
    • Total value of the prize pool is up to $9,655.70 (incl. of GST).
  1. The prize is non-transferrable and cannot be exchanged for another prize.
  2. In each case, prize winners will be published in print in the following daily publications on Wednesday September 20, 2017.

Draw and Notification

  1. The winners will be drawn via random electronic draw from all valid entries received in the Trades Toolbox 2.0 Competition, at APN Newspapers Pty Ltd, Newscorp office, 28 Mayne Road, Bowen Hills on Wednesday September 18, 2017 at 10:00am AEST.  
  2. Upon validation and verification of entries, the winners will be contacted by telephone and email within two (2) days of the draw.
  3. The Promoter’s decision of these proceedings is final and no correspondence will be entered in to regarding the outcome of the winners or any other decisions the Promoter makes about the competition.

Collection of Prizes

  1. All winners must sign a competition release form and provide evidence of identification and residence to secure their prize (unless otherwise advised).
  2. If prize winner/s have not collected their prize by the date specified at Clause 23, the prize/s will be redrawn at APN Newspapers Pty Ltd, Newscorp office, 28 Mayne Road, Bowen Hills Queensland 4006 on Thursday September 28, 20147 at 10:00am AEST. Redraw winners will be contacted by telephone/email within 2 days of this draw and names of winners published within 14 days of the draw.

Promoter’s limitation of liability

  1. All Contestants acknowledge that the Promoter has the right to publicise and publish the Contestant’s name, photographs and likeness.
  2. All Contestants must make themselves available for photographs if required by the Promoter and acknowledge that the Promoter has the right to use those photographs for publicity in any reasonable manner it sees fit without compensation to the Contestants.
  3. It is the Contestant’s responsibility to advise the Promoter of any change of personal details and contact details by providing written notice to the Promoter at the above address specified in General section of these Terms and Conditions.
  4. The Promoter bears no responsibility for incorrect personal or contact details which results in individual Contestants being exempt from participating in the Competition due to incorrect details on their Advertisement booking confirmation. 
  5. The Promoter is not responsible for any incorrect or inaccurate information, either caused by a Contestant or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  6. The Promoter is not responsible for lost, late, incomprehensible or incorrect Advertisement bookings in the Promotion Period.
  7. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings in the Competition.  All Contestants should seek independent financial advice about such matters.
  8. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside the Promoter’s reasonable control that would reasonably prevent the Competition from occurring, the Promoter is entitled to cancel, terminate, modify or suspend the Competition subject to written direction from any relevant regulatory authority.    
  9. If for any reason the Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter is entitled in its sole discretion to disqualify any Contestant who tampers with the Competition, and/or to cancel, terminate, modify or suspend the Competition subject to written direction from any relevant regulatory authority.
  10. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  11. If a dispute arises concerning the conduct of the Competition or the awarding of a prize, the decision of the Promoter will be final in relation to the matters arising from prize draws and notification and the decision of the Promoter will be final in relation to all other matters relating to the Competition and no correspondence will be entered in to.
  12. The Contestants release the Promoter and their related bodies from any and/or all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner because of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoter or the Competition.
  13. In the event of any third party, other than the Promoter, cancelling any event or failing to provide any goods or services relating to the Competition, the Promoter cannot be held responsible.
  14. The Runners Up and the Finalist each agree to participate in any news and other media activities surrounding the Competition (e.g. interview and photo for pages of the Promoter’s website and/or newspapers).

Entries and privacy

  1. All entries become and remain the property of the Promoter and its related parties, subject to the limits contained in the Privacy Statement and as set out in these terms and conditions.
  2. The Promoter and its related parties collect personal information to conduct the Promotion, including name and contact details and may use and disclose such information in accordance with its privacy policy, including to sending ongoing information and promotional material about opportunities, services and products (relating to our business or a third-party business) in which the Promoter believes you may be interested.

44. We collect and use that information to provide you with our goods and services and to promote and improve our goods and services. We may also share your information with our related companies and any of us may be in contact for those purposes (including email and SMS).

45.  Where you have entered a competition, we may disclose your personal information to authorities if you are a prize winner or otherwise required by law.

46.  Further information on how we handle personal information, how you can complain about a breach of the Australian Privacy Principles, how we deal with a complaint of that nature, how you can access or seek correction of your personal information and our contact details can be located at www.apnarm.com.au/privacy

47.  To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this promotion for marketing purposes.

48.  If you wish to opt out of sharing information with other companies, you can do this by writing to the Promoter at the address shown in these Terms and Conditions at Clause 1.
